To obtain U.S. citizenship, you must have been a legal resident for at least 5 years. If you obtained residency through marriage to a U.S. citizen, the required period of legal residency is reduced to 3 years.
There are certain rules and/or exceptions when obtaining your citizenship based on your stay in the United States, such as:
- If you are at least 50 years old and have been a legal resident for a minimum of 20 years, or if you are 55 years old and have 15 years of residency, you qualify to take the civic exam and interview in Spanish with the help of an interpreter.
- People over 65 years of age with 20 or more years of residency not only qualify for the interview in Spanish but also for a simplified civic exam.
Remember that:
- Qualifying for these accommodations does not mean the immigration officer will conduct the interview and exam in Spanish.
- Is your responsibility to bring a competent interpreter to facilitate communication between you and the immigration officer.
- USCIS does not provide an interpreter for your interview.
It is not always necessary to hire a lawyer to start the citizenship application process. You can complete the required forms yourself and/or with the assistance of an immigration interpreter/translator, who will offer you specialized guidance and advice.
It is advisable to avoid having a family member or acquaintance assist you, but rather a neutral person such as an immigration interpreter/translator. This approach ensures clear and accurate communication, provided by a professional in the subject and avoiding errors that could negatively impact your immigration process.
